BunkMeal, an online food ordering and preordering platform enable people to use BunkMeal for promotion, sale of food and discover offers. This page contains our Terms of Services, which will govern the use of BunkMeal services.
1. ACCEPTANCE OF BunkMeal TERMS OF SERVICES
1.1 Basic Definitions
This Terms of Use Agreement (“Agreement”) sets forth the legally binding terms for your use of the BunkMeal Services. You are only authorized to use the BunkMeal Services (regardless of whether your access or use is intended) if you agree to abide by all applicable laws and to this Agreement. Please read this Agreement carefully before using this website. By using the BunkMeal Services, you agree to be bound by this Agreement, whether you are a “Visitor” (which means that you simply browse the BunkMeal site) or you are a “Member” (which means that you have registered with BunkMeal). The term “User” refers to a Visitor or a Member. Kindly print these terms of use or save a copy of these terms of service for your records. If you do not agree with any of these terms, you cannot avail of any of the BunkMeal Services and you should leave the BunkMeal site immediately. If you wish to become a Member, communicate with other Members and make use of the BunkMeal Services, you must read this Agreement and indicate your acceptance during the Registration process. The term ‘authorized user’ would include any person, whether an individual or a legal entity who has subscribed to the services of BunkMeal, and to whom the access is restricted by the use of a sign in user name and a password. The user name and password are either allotted by BunkMeal or chosen by the user or agreed upon by BunkMeal. Therefore, only the authorized user has the right to access the services offered by BunkMeal. BunkMeal will not be responsible for any costs, consequences or damages caused to any persons or entities due to any unauthorized use of the services offered by BunkMeal, including access of the said services by an unauthorized user using the user name and password of an authorized user, regardless of whether such unauthorized user is known to the authorized user. The terms ‘service’ or ‘services’ would mean to include the interactive online solutions & information services offered by BunkMeal on the internet/mobile through which the user may access information carried by BunkMeal in the database maintained by it. You agree not to copy, sell, resell, and duplicate any part of BunkMeal’s services & solutions for commercial purposes. These Terms of Service sets out the legally binding terms of your use of BunkMeal and your membership in BunkMeal and may be modified by BunkMeal at any time and without prior notice, such modifications to be effective upon posting by BunkMeal on the website. If you do not agree to be bound by the terms of this Agreement, you may not use nor access our services.
1.2 Eligibility
BunkMeal services are available to all individuals who are at least 13 years of age. By registering to use BunkMeal services, you represent and warrant that you are at least 13 years of age. BunkMeal has the right, in its sole discretion, to suspend or terminate your use of BunkMeal services and refuse any and all current or future use of all or any portion of BunkMeal’s™ services.
1.3 Modification
BunkMeal reserves the right to alter, modify, replace or remove part of the Terms & Conditions without giving any prior notice. It is your responsibility to check the Terms of Services periodically for updates.
1.4 Service
BunkMeal are a Food Technology company that provides a Technology solution for the companies to modernize the food experience of employees by providing them top-class technology solutions in the form of our website, mobile applications and cafeteria tab application. BunkMeal integrate the vendors in the cafeteria on our platform through a vendor application which is used for managing employee orders. BunkMeal do not own any of the vendors and have no control over the services that are provided by the vendor.
2. Vendor Terms
BunkMeal offers Vendors a web-based solution to organize digital cafeteria, to sell food or provide online Preordering food solutions via the BunkMeal-Websites for Vendor to customers by using BunkMeal to take on the payment process. In detail, BunkMeal provides the following services to the vendor (each an “BunkMeal-Service”). A web-based software through BunkMeal-websites that allows vendors to sell food to buyer. The Vendor has the option to create his/her own website for cafeteria (“partner site”) and to offer food sale. The food buyer can choose and buy food on the cafeteria site directly. Only the user and the vendors are entering into an agreement regarding the cafeteria and the disposal of ordering food or preordering food. BunkMeal only acts as a service provider for the vendors by order and for account of this cafeteria. It is the vendor’s duty to advise and instruct the food buyers of their eventually existing right of objection according to the legal guidelines. You will not use the services for any activity that is of commercial in nature or unlawful or harmful for any individual or organization. If you use the same, all activities undertaken by the individual are attributed to the individual without any blame or responsibility assigned to BunkMeal .
2.1 Payment and Fees
BunkMeal products & services are available on the basis of transaction model. You will be entitled for a refund of any order only if the vendor cancels your order due to unavailability of food item ordered or any other reason as mentioned by the vendor.
2.2 Payment Processing Methods
BunkMeal offers Encryption for payment information – BunkMeal uses industry-standard encryption to provide protection for sensitive financial information, such as credit card/debit card/online banking information sent over the Internet, through third-party payment gateway providers. BunkMeal shall also ensure that all such third party payment gateway providers comply with PCI DSS (Payment Card Industry Data Security Standard);
2.3 Your Responsibility
You agree to handle the hardware (like cafeteria tablets, vendor tablets) provided by us with utmost care. We reserve the right to recover damages if found guilty by the employer or BunkMeal support. You will be solely responsible for the development, operation, and maintenance of your site and for all materials that appear on your site. The information provided by BunkMeal to you may be proprietary in nature. You acknowledge that you are not a competitor of BunkMeal, and agree not to share this information with any of our competitors. Any violation of these terms and conditions may cause us to terminate this agreement.
3. Buyers and Non- Vendors Terms
You agree to receive SMSs and emails from BunkMeal regarding order intimations and updates. The food that will be consumed by you in the cafeterias will be prepared by the vendors of that cafeteria. BunkMeal does not hold any responsibility on the food prepared by these vendors. You agree that BunkMeal is not responsible for the services or goods provided by the vendor and hence any issues arising due to the consumption of food. BunkMeal retain the right to terminate your account based on the input received from your employer without any notice. As a standard practice, all orders placed on BunkMeal are treated as confirmed and cannot be cancelled or transferred to another vendor. You will indemnify, defend and hold us harmless from all claims, damages, and expenses (including, without limitation, legal fees) relating to the development, operation, maintenance, and contents of your site as well as any goods or services provided or made available by you.
4 Intellectual Property Rights
We are the owner of intellectual property for all the services provided by us and hence are governed by the necessary copyright laws. You agree that BunkMeal owns all rights to the code, databases, visual-design and layout of the Service. BunkMeal claims no intellectual property rights over the material you provide to the Service. Your profile and materials uploaded remain yours. You may not use any robot, spider, other automated device, or manual process to monitor or copy any Content from the Service. You may not resell, duplicate or reproduce or exploit any part of the Service without the written consent permission of BunkMeal. You may not duplicate, copy, or reuse any portion of the visual design or layout of the Service without the prior written permission of BunkMeal. We are the owner of the Vendor application, cafeteria application, mobile applications for Android and iOS and the website (desktop and mobile) and hence any attempt to destroy, imitate or harm these applications will be considered as a breach of the Terms of Use.
5. Termination
You agree that BunkMeal may terminate your Member Account and access to the site for reasons including, but not be limited to, breaches or violations of the Terms or the BunkMeal Privacy Policy, a request by you to terminate your Account, discontinuance or material modification to the Services, unexpected technical issues or problems, extended periods of inactivity and requests by law enforcement or other government agencies. Termination of your BunkMeal Account includes elimination of access to the Service, deletion of your Account information such as your e-mail ID and Password and deletion of data in your Member Account as permitted or required by law.
6. Applicable Laws
All matters relating to your access to and use of the BunkMeal site shall be governed by the laws of the Republic of India. You hereby irrevocably consent to the exclusive jurisdiction and venue of courts in Hyderabad, India in all disputes arising out of or relating to the use of BunkMeal. Use of BunkMeal is unauthorized in any jurisdiction that does not give effect to all provisions of these terms and conditions, including without limitation this paragraph.
